Is the condominium obliged to have a PEC?

The PEC gives communications the legal value of a registered letter and it is legitimate to wonder if a condominium is required to have one. Here’s what you need to know

Is a condominium obliged to have a Certified Electronic Mail box? What about the condominium administrator? These are two legitimate questions to ask now that the CEM has become mandatory for registered professionals, companies and public administrations. The answer, however, is no, since the condominium is a management body that cannot be equated with a company.

Not even the condominium administrator is obliged to have a PEC, but this could be useful. In fact, the Certified Electronic Mail has the legal value of a registered letter with return receipt for all the cases provided for by the law, as long as the addressee is also equipped with it. The assembly of condominiums could still decide to open a PEC box to streamline their communications, using it with entities such as the Inland Revenue and banks, or to convene meetings and send reminders of payment.

Moreover, it can be used to convene the condominium assembly, send estimates and statements or payment reminders. It must be remembered, however, that the CEM sent will be valid only if the recipient is itself equipped with a certified mailbox.

Condominium administrator is required to have one?

The condominium administrators are not required to have a CEM, unless they fall into one of the categories for which it is mandatory according to Italian regulations. In any case, they will be able to subscribe as private individuals a PEC box to be used for personal use.
