The Council of State has published a new ruling on 28 days billing and once again there is good news for users. As already happened a few weeks ago with the sentence on the appeal presented by Vodafone, also this time the Council of State has rejected the appeal presented by a telephone operator against the regulations imposed by AGCOM. The appeal had been presented by Wind-Tre that therefore will have to adapt to the decisions of the administrative body.
The sentence confirms what has already been announced in the previous weeks: the reimbursement by the telephone operators must be automatic. They must not be the single users to send a form and to have to choose between the cancellation in bill and the activation of services to payments, but it must be the operator to activate the practice. Wind-Tre was also sanctioned with a fine of 1,160,000 euros. What changes with the Council of State’s ruling?
28 day billing: the decision of the Council of State
As happened for Vodafone in the case of the appeal ruling, the Council of State has rejected Wind Tre’s appeal, confirming AGCOM’s thesis on refunds for 28 day billing. In particular, according to what was also stated by the Council of State, given the actions taken by the operators, AGCOM preferred to activate its powers by protecting users with an instrument of widespread and automatic indemnity protection.
What does the Council of State ruling provide for
The Council of State ruling published on February 24 also sheds light on the amount due of the fine contested by Wind Tre. According to Wind Tre, the authority did not do the accounts properly, considering this penalty discriminatory and disproportionate. According to the Council of State, AGCOM’s choice is not only rational, but its impact is equal and valid for all operators.
How to request a refund of 28-day billing Wind
Wind customers can already now request a refund of 28-day bills. All you have to do is access the Customer Area and enter the dedicated section. Among the various possibilities of reversal, there is also the economic refund in the bill. By accepting this method, the money is reversed in the first available bill.
